UPMC Center for Continuing Education in the Health Sciences Patient Privacy Policy

It is the policy of the University of Pittsburgh Center for Continuing Education (CCEHS) to maintain the privacy of patients’ Protected Health Information (PHI) and to abide by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and with the University of Pittsburgh and the University of Pittsburgh Medical Center policies. PHI shall not be included in CME presentations including written, online, or audio/visual materials unless specific authorization has been obtained from the patient in a manner consistent with HIPAA. Of specific concern are enduring material activities including monographs, journal, online modules and webcast presentations.

The presenter must provide written documentation of authorization to the CCEHS in accordance with established activity deadlines. Items considered to be PHI and therefore to be removed include, but are not limited to, name, address, social security and medical record number, picture of face, any date associated with the individual (admission, discharge, birth, death), and implanted device serial numbers.

Specific Examples:

  • Patient identifiers on a visual presentation such as an xray or similar diagnostic image or test MUST be removed.

  • The use of identifiable patient images is not permitted unless specific and documented authorization has been obtained from

    the patient or parent/guardian .

  • The use of identifiable stock photo or clip art human images is not permitted unless documented permission to use the

    photos has been obtained.

  • Any data associated with an individual patient such as admission, discharge, birth or death is not permitted.

    It is the policy of the University of Pittsburgh Center for Continuing Education in the Health Sciences (CCEHS) to comply with U.S. Copyright Law and with the University of Pittsburgh copyright guidelines (located at http://www.ogc.pitt.edu/index.html ) and the University of Pittsburgh Medical Center copyright guidelines, as appropriate.

    Presenters are required to identify graphics, images and other information used in their presentation that is protected by copyright. The source of the cited material shall be properly acknowledged in a footnote on the slide. It is the responsibility of the presenter to ensure required copyright permission is obtained. Therefore, when preparing presentations it is advised not to use specific language (i.e. copying of text), images, illustrations, or cartoons without first contacting the copyright owner and obtaining permission. The CCEHS does not evaluate whether the educational material is original work and is not responsible for any copyright infringements.

    Should the material be used in an enduring material or live web cast additional requirements may be necessary at the discretion of the CCEHS.

    The following guidelines should be considered when preparing a presentation for an enduring material (i.e. monograph, journal, live web cast, CDROM, or online module.

    • The “fair use” defense for use of copyrighted material in a presentation is not applicable to publicly available educational materials.

    • When copyrighted material is used, the presenter must cite the source, which should include a valid copyright notice (i.e. Copyright © University of Pittsburgh 2003).

    • A work in the public domain (i.e. U.S. Government) can be copied freely by anyone.

    • Do not include cartoons or artwork
